Bill Tracker

Section 781 of H.R. 5371 (P.L. 119-37) rewrote the federal definition of hemp and set a 0.4 mg total THC per-container cap that would push most consumable hemp products into Schedule I. H.R. 6500, signed September 2, 2026, moved the effective date for most of that language from November 12 to December 11, 2026. Congress now has until then to pick a path, and there are four on the table. Repeal: H.R. 6209 and H.R. 9830 would strike Section 781 outright, with 9830 replacing it with a 1% total THC definition and an FDA pathway. Delay: H.R. 7024 and its Senate companion S. 3686 would push implementation to November 2028. Regulate: S. 3474, H.R. 7212, and H.R. 10079 would trade prohibition for a federal framework with serving limits, age gates, testing, and labeling. Opt out: S. 4315 would let states and tribes exit the federal scheme entirely. This tracker follows each of them through the 119th Congress.
